Terms of Use

The terms that apply when you access and use the Fiberpol Infrastructure website.

Fiberpol Inc. trading as Fiberpol Infrastructure · Effective date: 20 October 2026

01Website operator and scope

These Terms of Use govern access to infrastructure.fiberpol.com (the “Website”). The Website is operated by Fiberpol Inc., trading as Fiberpol Infrastructure (“we”, “us” and “our”). Contact us at [email protected] or Fiberpol Inc., Newton Plantation Yard, Christ Church, Barbados.

Please read these terms before using the Website. By using the Website, you agree to these terms to the extent a binding agreement is formed under applicable law. If you do not agree, please stop using it. If you act for an organisation, you must have authority for the actions you take on its behalf. Our Acceptable Use Policy forms part of these terms.

Our Privacy Policy and Cookie Policy explain our data practices and your choices. Agreement to these terms does not supply consent to marketing. Our Cookie Policy explains how optional cookies are used and how to switch them off.

02Information and enquiries

The Website provides information about infrastructure products and related offerings for visitors in Barbados and Saint Lucia. Submitting an enquiry or quotation request does not by itself place an order or create a supply or services contract. Any purchase, installation, delivery, warranty or project engagement is governed by the separate terms agreed for that transaction and applicable law. These website terms do not change an existing contract.

We aim to keep information accurate and current. Product images, colours, dimensions, specifications, stock information and availability may change; confirm current details with us before ordering or specifying a product. We will correct errors when identified. Nothing in these terms permits misleading statements or removes responsibility for a representation where the law makes us responsible.

03Technical information and product selection

Website descriptions, brochures, drawings and other technical material provide general information. They are not a site-specific design, engineering opinion, approval or instruction to carry out hazardous work. Product suitability depends on the application, site conditions, loads, local approvals and the current manufacturer’s instructions. Obtain appropriate qualified advice and confirm the relevant specification before making a project decision. This does not limit any duty or responsibility we expressly accept under a separate agreement or that applicable law imposes on us.

04Permitted use and intellectual property

We or our licensors own the Website content and associated intellectual property, except where otherwise stated. You may view and download content for personal use and legitimate internal business evaluation. You may share unaltered product documents with your project team or professional advisers for evaluating or specifying our products, retaining attribution and any copyright or safety notices.

Any other commercial republication, resale, adaptation or use of our branding requires permission unless permitted by law or the rights owner. Do not imply endorsement, remove ownership notices or present our materials as your own. Third-party marks and documents remain subject to their owners’ rights.

05Information you submit

Provide accurate information and submit only material you are entitled to share. You retain your rights in your submissions. You give us a limited permission to receive, store, copy and share them with personnel and service providers as reasonably necessary to handle your request, operate the Website and meet legal obligations, subject to our Privacy Policy. This permission does not authorise public promotion or unrelated reuse of your project materials.

General website forms are not intended for highly sensitive material. Contact us to agree an appropriate channel and any additional confidentiality terms before providing restricted project information. We still handle personal data and any duties of confidence in accordance with applicable law.

External links and embedded services are provided for convenience. Their operators control their content and terms, and a link does not imply our endorsement. We take reasonable care in operating the Website but do not guarantee uninterrupted availability, compatibility with every device, or freedom from all errors or harmful code. We may make reasonable changes or suspend access for maintenance, security or legal reasons.

07Misuse and access restrictions

You must comply with the Acceptable Use Policy. Where reasonably necessary to address a breach, security threat or legal obligation, we may limit access, remove material or take other proportionate action. Where practicable and lawful, we will explain the reason and consider a request for review sent to [email protected]. Urgent security action may take place without advance notice. A restriction on website access does not by itself terminate a separate customer contract.

08Responsibility and limits

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability, statutory guarantee, consumer right or remedy that cannot lawfully be excluded or limited. This includes mandatory protections applicable in Barbados and Saint Lucia.

Subject to those protections, our responsibility for loss arising from website use is determined by applicable law. For business users, to the extent lawful and reasonable, we exclude indirect or consequential loss and loss of business profit, revenue or opportunity resulting from use of this informational Website. We do not impose a blanket exclusion of all liability or a financial cap through these website terms. Product or project liabilities are addressed in the relevant agreement and applicable law.

09Governing law and disputes

These website terms are governed by Barbados law, subject to any mandatory law that applies to you, including mandatory consumer protections in Saint Lucia. The courts of Barbados have non-exclusive jurisdiction. This does not prevent a consumer from bringing proceedings in another court where applicable law gives that right, or from approaching a competent regulator. You may contact [email protected] to try to resolve a concern informally, without delaying any statutory remedy or deadline.

10Changes and general provisions

We may revise these terms for future use of the Website. We will publish the revised terms with their effective date and give reasonable notice of material changes where practicable or legally required. Changes do not retrospectively remove rights that have already arisen or amend separate contracts. If a provision is unenforceable, the remaining provisions continue so far as the law permits. Any failure to enforce a provision on one occasion does not by itself waive the right to enforce it later.
